Hallmark Cards Inc. failed to persuade a federal appeals court to throw out Paris Hilton’s lawsuit accusing the card company of wrongfully using her name and image on a birthday card.
The U.S. 9th Circuit Court of Appeals on Monday ordered the suit to proceed, upholding a lower-court decision that denied Hallmark’s request to dismiss the suit and rejected the card company’s defense that the card was in the public interest.
“Hallmark cannot employ the public interest defense because its birthday card does not publish or report information,” Judge Diarmuid O’Scannlain wrote on behalf of the three-member panel.
Hilton, a hotel heiress who is “famous for being famous,” according to the judge, had starred in the television show “The Simple Life” and in one episode worked as a waitress in a fast-food restaurant. The Hallmark card has a caption reading “Paris’s First Day as a Waitress,” with a photo of Hilton’s head superimposed on a cartoon waitress’ body.
Hilton seeks at least $100,000 in damages, according to a complaint filed in federal court in Los Angeles. She accuses closely held Hallmark of commercial appropriation of identity and invasion of privacy, among other claims.
